Terms and Conditions
The following General Terms and Conditions apply to any reservation in addition to the individual agreements communicated to the client before conclusion of the contract, to which the client will agree according to the following terms and conditions.
1. Conclusion of the Contract
SALUDCENTERTOUR after planning the individual journey with THE CLIENT will send him an email with the description of the planned journey, its price and the individual conditions which applies to the journey. This email has to be considered as the offer to the CLIENT.
The CLIENT will have to confirm the content via email by which he accepts the contract including the present General Terms and Conditions. Any changes the CLIENT would like should be communicated at this moment (afterwards changes are not obligatory for SALUDCENTERTOUR and cannot be guaranteed); in this case SALUDCENTERTOUR will send a new email, which will constitute a new offer.
Subsequently, SALUDCENTERTOUR will send another email to the CLIENT confirming the reservation by which it becomes binding and the contract is concluded.
2. Obligations and Responsibilities of the Parties
SALUDCENTERTOUR’S obligation is to guarantee the proper execution of the journey agreed with the CLIENT according to Term n°1. This content cannot be expanded neither by the parties unilaterally nor by any of SALUDCENTERTOUR’S service providers, but only by the parties themselves, explicitly and by mutual agreement.
Concerning the medical treatments - except the chiropractic - and the other services provided by third parties (guides, drivers, partner hotels, etc.) SALUDCENTERTOUR is only intermediary. The contract is so concluded between THE CLIENT and the service provider (= the third party), although SALUDCENTERTOUR has the obligation of correct organization and will receive the CLIENT’S money to pay the third parties. However, the service providers are well known to SALUDCENTERTOUR and reliable.
In consequence, under no circumstances SALUDCENTERTOUR can be hold responsible for:
- any incorrect treatment and damages caused by the medical treatments (except chiropractic)
- damages caused during the tours (of third parties) or the stay at the accomodation in Santa Marta or other accommodations
- crime, losses, street blockades, accidents, natural disasters and any other kind of unforeseeable events (force majeure).
Nevertheless, SALUDCENTERTOUR shall - without affecting the above exclusion of liability - assist THE CLIENT in any necessary correspondence.
SALUDCENTERTOUR is further not obligated and cannot be hold responsible for information concerning entry requirements to Colombia (visas, vaccinations, etc.) or any interference caused by typic and usual circumstances of the country, such as loud music till late hours, blowholes on street, insects, power cuts or no hot water in all places.
THE CLIENT’S obligations are:
- to provide SALUDCENTERTOUR correctly with all necessary information to organize the journey, especially for medical treatment
- to pay the agreed price of the journey and on site booked tours to SALUDCENTERTOUR
- to comply with all legal requirements of the country (valid passport, visas, etc.)
- to notify SALUDCENTERTOUR immediately about any problem that could affect the correct execution of its obligations in order to solve the problem
THE CLIENT is responsible for any damage caused by not executing his obligations.
We recommend to subscribe to a travel insurance.
3. Payment and Cancellation
As specially the housing is offered by a third party having its own pricing policy, SALUDCENTERTOUR will need to ask you a deposit before travel. This deposit (usually about 30-50% of the total price), which will be communicated to THE CLIENT before his confirmation of the journey, has to be paid within 10 days after conclusion of the contract (see Term n°1). The rest of the price can be paid on site the day of arrival. If payment is done by bank transfer the amount has to be received by SALUDCENTERTOUR at last the day of THE CLIENT’S arrival.
SALUDCENTERTOUR may cancel the contract without previous notice:
a) if and when THE CLIENT fails to comply with its duty of payment or payment of the remaining amount in accordance with the terms and conditions just mentioned.
b) if SALUDCENTERTOUR becomes aware that THE CLIENT has consumed drugs or committed any other offence punishable by local law
c) in case of unforeseeable and unavoidable event (force majeure).
In cases a) and b) there will be no refund. In the case of force majeure there will be reimbursement of the deposit or the remaining amount as long as the payment and the force majeure occurred before the arrival of THE CLIENT. As a precaution, it is clarified that legally, in general, impediments related to transportation to Santa Marta by THE CLIENt or getting sick are not cases of force majeure.
THE CLIENT must be responsible for the total payment of the transfer costs. Failure to do so will be considered as no payment.
The CLIENT therefore has the right to cancel the contract without reason at any time prior to arrival and free of charge by email. However there will be no refund of the deposit except in case of force majeure.
4. Validity of Website Information and disponibility of service
All information on the website is a proposal for travel, but no contract offer (see Term n°1). It is subject to change as long as the contract is not concluded, but THE CLIENT will be informed about any change.
Disponibility of the Extra packages which are not booked in advance before the arrival in Colombia and assistance in the languages other than Spanish for these packages is not guaranteed. However, SALUDCENTERTOUR will do its best to offer it to the CLIENT.
5. Individual Agreements
The present General Terms and Conditions can be modified by the parties by mutual individual agreement, which has to be written in the contract (see Term n°1).
6. Choice of Law, Jurisdiction
SALUDCENTERTOUR is a registered company in Colombia. Place of execution of the contract is Colombia. To the contract between THE CLIENT and SALUDCENTERTOUR applies Colombian law. Jurisdiction for any claims is Santa Marta (Colombia).
